Owlâs Nest â Cozy Cabin by lake and trails
A new Maine Cabin located across the street from Lake Sherburne. Wake up and enjoy your coffee on the back deck watching the Sunrise surrounded by nature or start your day with a Kayak on the lake. Spend the day hiking the trails adjacent to the property or ride the nearby ATV trails. End the night with friends and family around the fire pit outback. The house is a short 45 minute drive to the Portland Jetport or the surrounding ocean beaches.
The entire home with the exception of the basement is open for use.

WAIVER, RELEASE, and INDEMNIFICATION
In consideration for my being permitted to rent, possess, and enjoy the real and personal property located at and upon 69 Bernier Lane, Town of Waterboro, State of Maine (âPropertyâ), and as a necessary element in consideration therefore, I agree to the following release, waiver, and indemnity:
FIRST: I acknowledge that camping and lake front properties have obvious inherent risks, hazards, and dangers for anyone that cannot be eliminated.
SECOND: I acknowledge that all swimming and recreational water activities have obvious inherent risks, hazards, and dangers including the risk of drowning, serious bodily injury, and death. I acknowledge that there are no lifeguards on duty on premises and that any and all recreational water activities are undertaken at our own risk, and that should children be present on the premises Maine law directs and mandates that direct supervision of children in and around water must be maintained at all times.
THIRD: I acknowledge that the Property includes access to kayaks and other recreational devises. Due to changing weather and water conditions, the kayaks and recreational devises may not be available, functional, or safe to use during my stay. Use of the kayaks and recreational devises is strictly at my own risk. I acknowledge that kayaking and recreational water activities are an inherently dangerous recreational activity involving risks including, but not limited to, serious injury, drowning, and death. Renter and all users of the kayaks and recreational devises assume full responsibility for any and all risks, known or unknown, related to their use, including those arising from equipment failure, weather conditions, water conditions, or personal negligence.
Only adult-sized U.S. Coast Guard-approved life jackets are provided. Use of life jackets is mandatory. State law requires each person on board to have a properly fitting, serviceable life jacket. Children 10 and under must wear a life jacket at all times while on the water.
By using or permitting others to use the kayaks and recreational devises, the Renter and all
occupants agree to take all necessary safety precautions to mitigate risks, waive any and all claims against the Property Owner and affiliated parties (âReleased Partiesâ) for any injury, loss, damage, or death arising from use of the kayaks and recreational devises, agree to indemnify, defend, and hold harmless the Released Parties from any and all liabilities, claims, damages, losses, costs, or expenses (including attorneyâs fees) arising from use of the kayaks and recreational devises by the Renter, occupants, guests, invitees, or others accessing the kayaks during the stay, whether such claims arise from inherent risks or alleged negligence.
Kayaks will remain locked until the Renter has confirmed that they have read, understood, and agreed to these terms, and have communicated them to all guests or individuals who may use the kayaks.
FOURTH: I acknowledge that bunk beds exist upon the Property. I acknowledge that I will ensure that the bunk ladder(s) and rail(s) are secure before use. Children under the age of 6 should not use the top bunk. Renter agrees to use the bunk bed at their own risk and to hold Property Owner harmless for any and all damage and/or injury caused by use of said bunk beds.
FIFTH: I am VOLUNTARILY ENGAGING in use of the Property provided by the Property Owner with FULL KNOWLEDGE of the inherent risks, hazards, and dangers involved and hereby ASSUME AND ACCEPT any and all risks of injury, paralysis, or death.
SIXTH: I, for myself, my heirs, successors, executors, and subrogees, hereby KNOWINGLY AND INTENTIONALLY WAIVE AND RELEASE, INDEMNIFY AND HOLD HARMLESS Property Owner, its officers, employees, agents, shareholders, affiliate whatsoever in nature from and against any and all claims, actions, causes of action, liabilities, suits, expenses (including reasonable attorneys' fees) which are related to, arise out of, or are in any way connected with my use of the Property, including, but not limited to, NEGLIGENCE of any kind or nature, whether foreseen or unforeseen, arising directly or indirectly out of any damage, loss, injury, paralysis, or death to me or my property as a result of my engaging in use of the studio or the use of any personality or fixture therein or thereof, whether such damage, loss, injury, paralysis, or death results from negligence of Property Owner, its officers, employees, agents, shareholders, directors, or from some other cause. I, for myself, my heirs, my successors, executors, and subrogees, further AGREE NOT TO SUE Property Owner, its officers, employees, agents, shareholders, or affiliates whatsoever as a result of any injury, paralysis, or death suffered in connection with my use of the studio.
I HAVE CAREFULLY READ, CLEARLY UNDERSTAND, VOLUNTARILY AGREE
TO THIS WAIVER AND RELEASE, AND ACKNOWELDGE AND AGREE THAT THIS
WAIVER AND RELEASE IS INCORPORATED INTO AND MADE PART OF MY AIR
BNB RENTAL AGREEMENT WITH PROPERTY OWNER. BY ENTERING INTO
SAID RENTAL AGREEMENTI CERTIFY THAT I HAVE VOLUNTARILY WAIVED
MY RIGHT TO MAINTAIN ANY LAWSUIT AGAINST PROPERTY OWNER, ITS
OFFICERS, EMPLOYEES, AGENTS, SHAREHOLDERS, OR AFFILIATES.
